Nexus, as a United States company operating in Essex County, Massachusetts, follows the guidelines contained in the Stored Communications Act (18 U.S.C. § 2701 et seq.) and all other relevant statutes and regulations. The Stored Communications Act governs Nexus’s ability to produce or disclose certain categories of records in response to a wide range of legal processes, which can include valid subpoenas, court orders, and search warrants. Nexus will, to the best of its ability, comply with these requirements by insisting that all requests for user content, user communications, or other protected information be accompanied by the correct form of legal documentation. Specifically, any law enforcement or governmental agency seeking private user communications or content (such as posts or messages made through Nexus’s services) must provide a properly executed search warrant issued by a court of competent jurisdiction, which may be either a federal court or a court with general jurisdiction in the relevant state. Meanwhile, basic user account information may be obtained through a valid subpoena, while other non-content records—such as activity logs, non-content interactions, or similar data—may be obtained with a court order that complies with 18 U.S.C. § 2703(d).

Nexus reserves the right to notify users of any legal request for their information unless expressly prohibited from doing so by a non-disclosure order that is legally valid and consistent with 18 U.S.C. § 2705. Law enforcement officials or governmental agencies must provide Nexus with such an order if they believe that revealing the existence of the request to the user could jeopardize an investigation or create other risks. If a particular state’s statute or legal framework indicates that a separate process is acceptable in lieu of, or in addition to, such an order, the requesting authority must identify that statute or process when submitting the non-disclosure request to Nexus.

Nexus also wishes to highlight that individual users possess the ability to download and retain their own account data by using the tools that Nexus makes available to them. This functionality reflects Nexus’s emphasis on providing users with as much control over their data as reasonably feasible under the law. For purposes of this document, it is noted that users are not obligated to procure legal process in order to access their own data.

Data Retention:

Nexus’s policies for storing and retaining user data are discussed in detail in the Privacy Policy and Terms of Service, both of which are made available to users at the appropriate time and through the company’s official channels. In line with these policies, Nexus maintains a variety of records for specific durations as required by operational needs, legal obligations, or user expectations. In order for Nexus to thoroughly evaluate such emergency requests, it is essential for law enforcement agencies or governmental officials to provide as much information as possible about the nature of the threat, including the reason why this situation is considered imminent, how the requested records are pertinent to the prevention or mitigation of that threat, and why conventional legal processes (such as obtaining a subpoena or warrant) would not be feasible within the needed timeframe. Nexus encourages requesting parties to identify the scope of the records they are seeking in a precise manner so that the review can be completed as quickly and accurately as possible.

Preservation Requests:

Nexus honors valid and properly submitted preservation requests in accordance with 18 U.S.C. § 2703(f). Upon receiving a written preservation request, which must be issued on the official letterhead of a law enforcement department, dated, and signed by an appropriate authority, Nexus will take steps to preserve the relevant account records for up to ninety days. Should the requesting authority require an additional preservation period, it must submit an appropriate request before the original preservation timeframe expires, which will lead Nexus to preserve the same records for one additional ninety-day interval. This procedure ensures that evidence remains intact while the requesting agency takes the necessary steps to secure the appropriate form of legal process or to evaluate whether the data in question should indeed be obtained. The preservation process is designed to protect the integrity of potential evidence while balancing the interests of user privacy and due process.

How To Submit A Request:
