UK Member Agreement
If you live in the United Kingdom, your access to and use of our Services is governed by this UK Member Agreement (“Terms”). If you are located in the European Union, please see our EU Member Agreement; if you reside elsewhere, please see our general Member Agreement. If you use our Business Services, additional terms apply; if you have a Public Services Page, separate terms may also apply.
1. Introduction to Nexus:
Nexus is a real estate brokerage, community platform, marketing, and tech company that aims to help neighbors connect with the communities that matter to them so they can thrive—online and offline. When we say “Nexus,” “we,” “us,” or “our,” we mean Nexus Real Estate Group. These Terms concern your rights and obligations related to all of Nexus’s websites, domains, applications, products, features, and marketing campaigns (collectively, the “Services”), provided you primarily reside or are established in the UK.
These Terms do not apply to agencies or to non-Member customers, and the Services referenced here exclude Public Services Pages and any non-Member advertising offerings. By registering for or otherwise using our Services, you either become a “Member” (if you register) or remain a “Visitor” (if you do not). By accessing or using our Services in any capacity, you confirm you have read, understood, and agree to be bound by these Terms as a legally enforceable contract with Nexus.
Whenever your purposes for using the Services are mainly personal, you are considered a “consumer.” Whenever you act for trade, business, craft, or professional reasons (including on behalf of a business), you use the Services in a “business” capacity. If you accept these Terms on behalf of any organization or other legal entity, you confirm you have the authority to bind that entity, and “you” or “your” refers to it.
The ways we collect, use, and share personal data are described in our Privacy Policy and Cookie Policy. Some Services (like Business Services) are subject to further terms, policies, or guidelines (“Supplemental Terms”), which will be shown to you on or through the Services. If these Terms conflict with any Supplemental Terms, the Supplemental Terms govern regarding that Service.
2. Joining the Neighborhood:
Eligibility:
You may only use our Services if you can legally enter into a binding contract under UK law, and only to the extent these Terms and all relevant laws allow. You cannot use the Services if (1) you are under 13; (2) you are on a sex-offender registry or barred from online platforms that minors can access; (3) your prior account was disabled by us for violating these Terms or related policies; (4) our Services are unavailable or not directed to your location; or (5) you are otherwise legally restricted from receiving or using our Services. Unless stated otherwise in the Business Services Terms, we reserve the right to refuse or revoke your registration, access, or use at any time.
Becoming a Member:
When signing up, you must provide accurate and complete information. We can reject or terminate any registration if we suspect it contains false details or otherwise violates these Terms.
Account Types and Access:
You may maintain an account (“Account”) for personal and/or business use. If you operate a Business Page or use other Business Services, you agree to be bound by our Business Services Terms. Each individual may only have one Account tied to their primary residence; each business location is similarly limited to one Account. You alone must keep your login details secure, and you should notify us immediately if you suspect unauthorised access to your Account. You are responsible for all activities under your Account credentials.
Permitted Use and Advertising:
You must only interact with the Services in the ways we make available (our website, apps, APIs, etc.), respecting any Supplemental Terms. Since many parts of the Services are provided for free, we rely on advertising revenue to support them. Accordingly, you accept that we may show you advertisements or sponsored content based on your activities or personal data, consistent with our Privacy Policy and applicable law.
3. Our Licence Grant to You:
Subject to your complete compliance with these Terms and any other relevant guidelines or policies, Nexus grants you a limited, revocable, non-sublicensable, non-transferable, and non-exclusive licence to access and use the Services in the manner we provide. This licence is not a sale of any portion of the Services. Nexus retains full right, title, and interest in all aspects of the Services, including all enhancements or updates.
4. Rights You Grant:
General Content Submission:
Certain features let you share text, photos, videos, information, comments, likes, recommendations, or other content (“Member Content”). You own any rights you hold in your Member Content.
Licence to Nexus:
To the extent permitted by law, you grant Nexus a worldwide, perpetual, royalty-free, and transferable licence (including sublicences through multiple tiers) to host, copy, modify, publish, translate, distribute, publicly perform, publicly display, create derivative works, and otherwise use your Member Content. We will respect your privacy settings, choices you make when posting, and data protection regulations. You confirm (and, if you are a business user, you also warrant) that you either own or otherwise have the necessary permissions to grant Nexus these licence rights.
Licence to Other Users:
You likewise grant every user of the Services a non-exclusive licence to access your Member Content within Nexus, as allowed by the Services’ functionality and these Terms.
Sponsored Content Use:
Where lawful, you authorise Nexus to display your name, neighborhood, profile photo, or details about your service interactions (e.g., “likes” or other engagement) alongside ads, offers, or sponsored Content—without further compensation to you. We may also repost your interactions or your Member Content within different areas of the Services, including in connection with a business’s ads and Business Pages, in line with data protection laws and our Privacy Policy.
Feedback:
We welcome any suggestions, ideas, or proposals for improving the Services (“Feedback”). By offering Feedback, you grant Nexus an unrestricted, perpetual, irrevocable, non-exclusive, fully paid, sublicensable, and transferable licence to use it as we see fit.
Sharing Content and Software Updates:
We invite you to share Content from Nexus only via our sharing features (like a Share button). Any other copying, scraping, or redistribution is prohibited. Installing or using certain parts of Nexus may require downloading software to your devices, which might auto-update for you to continue using our Services. By continuing to use Nexus, you agree to accept such updates, which are governed by the then-current Terms.
5. Being a Good Neighbor:
Community Guidelines:
Nexus’s Community Guidelines outline how we expect users to behave. These Guidelines apply to everything you post or upload, including group posts and private messages. While we do not promise to monitor all Member Content, we can limit or remove material that we conclude violates these Guidelines or is otherwise harmful, and we may suspend or delete your Account if you seriously or repeatedly breach these Terms, infringe third-party rights, or engage in behaviour that endangers Nexus or its users.
Prohibited Conduct:
You must not (1) attempt to hijack or use any Nexus system or another user’s Account without proper authority; (2) post harmful code, perform denial-of-service attacks, spam others, or otherwise interfere with our Services; (3) intrude into non-public areas of the Services or our computer systems; (4) probe or test any aspect of our security measures without permission; (5) perform facial recognition or biometric analysis on other people’s content; (6) employ automation (bots, crawlers, scripts) to scrape or copy data from the Services (including for AI training purposes) unless authorised; or (7) use Nexus in any way that contravenes the law or these Terms. Attempts to do any of these are similarly prohibited.
Member Disputes; Waiver of Claims:
Disagreements sometimes arise among neighbours. Nexus is not responsible for the conduct of individual Members, whether online or offline. Each user bears responsibility for their own actions and postings. By using the Services, you agree that Nexus has no liability for the conduct of Members or any other third parties.
Community Moderation:
Certain Members can access additional moderation tools on a volunteer basis. Such volunteers do not act as employees or official agents of Nexus, and we are not liable for actions they take while moderating. We may overturn or change a volunteer moderator’s decision if we deem it not in Nexus’s interest, and we can revoke or limit these privileges at any time. If you have these tools, you must not represent yourself as authorised to act on Nexus’s behalf, and you may not accept compensation or gifts for moderation activities.
6. Member Transactions:
Transactions Between Members:
Nexus does not own or manage items or services listed by Members (e.g., in “For Sale & Free” or on Business Pages). Any sale, lease, or work agreement is solely between the offering Member and the acquiring Member; Nexus does not process payments for these user-to-user dealings.
Engaging Other Members:
We do not interview, monitor, or verify user backgrounds. Finding a service or contractor via Nexus does not create any official employer-employee or agency relationship with Nexus. If you decide to engage another Member, both parties are responsible for abiding by any relevant legal obligations, including tax and employment rules. Nexus is not your agent, nor does it provide labour services, franchising, or joint venture oversight.
Prohibited Transactions:
Unless specifically allowed by our Services and Community Guidelines, you may not use the platform to solicit, promote, or contact users for commercial activities unrelated to our Services. You also may not harvest personal data or contact details from other Members without their explicit, informed consent or our prior written permission.
Venue Only:
Nexus merely offers a forum for individuals and businesses to find each other. We have no involvement in user negotiations, agreements, or transactions. We do not guarantee items or services, nor do we validate user claims. While we may help if issues arise, we have no control over the outcome or the integrity of participants. Use caution and common sense in all interpersonal interactions.
7. Notification Preferences and Invitations:
Notifications:
By default, you will receive messages (e.g., system updates, alerts) from Nexus, often by email, device notifications, or in-app notices. You can customise or restrict these notifications in your preference settings.
Invitations:
Nexus allows you to invite non-Members by post, email, or text. These invitations are initiated by you, although the Services may facilitate sending them. Certain carrier or data charges (such as texting fees) are your sole responsibility.
8. Promotions
We may occasionally host sweepstakes, contests, or other promotions (“Promotions”). If you decide to participate, ensure you read the Promotion-specific rules in addition to our Privacy Policy. Any conflict between those rules and these Terms or our Privacy Policy will be resolved in favour of the Promotion’s own terms.
9. Third-Party Sites and Services
Our platform may link to external websites, advertisements, offers, or events run by third parties. We do not own or control these external resources, nor do we endorse them. If you choose to interact with third-party services, you do so at your own risk and under their separate terms. Nexus is not liable for any issues that may arise from your use of such external sites or services.
10. Changes to Our Services
We may create new features, modify existing ones, or cease some or all of our current Services at any time. You accept that we can do so with or without prior notice. If you dislike any change, your only recourse is to discontinue using the affected feature or the Services altogether.
11. Third-Party Licensor Restrictions
Our Services may rely on data or support from external providers. When you use features subject to such third-party terms, you must adhere to those applicable requirements and disclosures.
12. Your Responsibility for Claims Against Us / Indemnification:
If you are a consumer accessing our Services for personal use, you remain responsible for any consequences of your acts or omissions under applicable law. If you are a business user (including individuals acting on behalf of a business as defined in our Business Services Terms), you agree to defend and indemnify Nexus (and all related entities, officers, directors, employees, and partners) against any third-party claims or liabilities (including legal fees) that arise from (1) your use of the Services; (2) your breach of these Terms; (3) your violation of laws or regulations; (4) your infringement of other users’ or third-party rights; (5) your interactions or transactions with other Members; or (6) your Member Content. Nexus may assume control of the defence in any indemnified matter, and you agree to fully cooperate. This section’s obligations survive even if your Account is terminated or you stop using the Services.
13. Disclaimers; Limitations of Liability:
Disclaimers:
The Services are offered “AS IS” and “AS AVAILABLE,” and we strive to minimise disruptions and provide reliable information but cannot guarantee uninterrupted, error-free, or always accurate operations. To the fullest extent permissible by law, Nexus disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We accept no liability for content removal, data loss, device harm, viruses, or problems beyond our reasonable control.
Liability Caps:
If we fail to meet our obligations under these Terms, we are only liable for losses that are foreseeable consequences of our breach or negligence. If you use the Services on behalf of a business, we shall not be liable for indirect or consequential losses (like lost profits, goodwill, or data). In any case, the total liability of Nexus or its affiliates is capped at the greater of (a) the total amounts paid to Nexus by you during the six months preceding the incident, or (b) £100 (GBP). This limitation applies irrespective of the legal theory involved (warranty, contract, tort, etc.) and even if a remedy is deemed to have failed in its essential purpose.
Conduct of Other Members / Not a Broker:
You are responsible for your communications and dealings with other users. Nexus does not promise that goods or services from third parties will fulfil your expectations, nor do we verify their content or statements. Because Nexus is a real estate brokerage, marketing, and tech company but does not give financial or legal advice, we are not to be viewed as a solicitor, escrow agent, lender, or real estate broker acting on your behalf. Nothing here restricts your statutory consumer rights, which remain intact.
14. Governing Law and Dispute Resolution:
Governing Law:
These Terms and any non-contractual disputes relating to them are governed by English law.
Dispute Resolution:
If a disagreement arises between you and Nexus, our aim is to provide a neutral and efficient way of resolving issues. Please see our Complaint Handling and Dispute Resolution Procedures for guidance.
Consumers:
As a consumer, you may bring legal proceedings in the English courts, or in the courts of Wales, Scotland, or Northern Ireland if that is where you live. Nexus may also bring proceedings in the courts of your home jurisdiction.
Businesses and Arbitration:
If you are using the Services on behalf of a business, you and Nexus agree that disputes will be resolved via arbitration under LCIA Arbitration Rules in London, with a single arbitrator, in English, governed by English law. If you do not accept these arbitration terms, you must discontinue using the Services.
15. General:
Term and Termination:
These Terms are effective from the date you accept them and remain in force unless terminated. You may close your Account and discontinue using the Services at any time. We may also suspend, delete, or terminate your Account or our Services at our discretion, with or without notice, without liability to you. Clauses concerning your licences to Nexus, indemnification, disclaimers, liability, and dispute resolution survive termination.

Infringement Claims:
If you believe any content in the Services infringes your copyright or trademark, contact us at legal@nexus.realestate. Additional details are provided in our Trademark and Copyright Policy.
Entire Agreement and Supplemental Terms:
If you are a business user, these Terms (along with any Community Guidelines, Business Services Terms, or other referenced policies) set out the entire agreement between you and Nexus concerning the Services, unless otherwise stated. Where any direct conflict occurs between these Terms and certain Supplemental Terms, the Supplemental Terms govern.
Updates:
We may modify these Terms or Supplemental Terms anytime. If changes are significant, we will notify you—e.g., by email or a notice in your local feed. Amendments apply immediately to new Visitors. If you continue using the Services after the changes become effective, you accept them. If you disagree, you must stop using the Services and close your Account.
Notices:
All official notices to Nexus must be in writing, sent to Nexus Real Estate at 205 River St, Haverhill, MA, USA 01832 or legal@nexus.realestate. Notices are effective upon receipt.
No Agency Relationship:
These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and Nexus.
Miscellaneous:
You may not assign any of your rights or obligations under these Terms without our prior written consent. If any clause is ruled unenforceable, the remainder remains valid. Our failure to act on a particular breach does not waive our right to address future or similar breaches. We are excused from failures caused by events beyond our reasonable control. Only you, Nexus, and our affiliates and licensors are intended beneficiaries of these Terms; no other third parties have enforceable rights here. If you (or individuals or entities associated with you) are subject to sanctions or on restricted lists, you must inform us immediately.
