If you are using Nexus Business Services, your access and activities are governed by these Commercial Terms. If you are located in the European Union, your use is governed by the EU Commercial Terms, and if you are in the United Kingdom, your use is governed by the UK Commercial Terms. These Commercial Terms apply to businesses, professionals, and entities engaging in commercial activities on the Nexus platform.

1. Use of Nexus for Business Purposes:

Nexus provides a platform designed to connect businesses, real estate professionals, and digital communities, enabling commercial engagement, service promotion, and professional networking. By using Nexus Business Services, businesses can list properties, advertise services, interact with customers, and build a digital presence within their communities.

By using Nexus Business Services, you confirm that you have read, understood, and agreed to these Commercial Terms. If you are acting on behalf of a company, organisation, or legal entity (a "Business"), you warrant that you have the authority to bind such an entity to these Terms.

2. Business Services Eligibility and Compliance:

Nexus Business Services are available to verified businesses and professionals who comply with applicable laws, industry regulations, and platform policies. Nexus reserves the right to verify any business before granting access to Business Services and may refuse or revoke access if eligibility requirements are not met.

Businesses using Nexus must ensure compliance with consumer protection laws, advertising standards, and data protection regulations. All business interactions on Nexus must be conducted professionally, transparently, and in good faith.

Nexus reserves the right to suspend or terminate Business Services if a business engages in deceptive practices, violates legal obligations, or participates in activities that harm users or the platform. In such cases, notice will be provided along with an opportunity for resolution unless immediate action is required.

Businesses may terminate their use of Nexus Business Services at any time by deactivating their Business Page, but any outstanding financial obligations remain enforceable.

3. Business Services and Content Management:

Business Pages serve as the digital storefronts for businesses on Nexus, allowing them to showcase services, post listings, and interact with the community. Business Pages may be created by businesses, recommended by users, or generated from publicly available data. These pages may be visible to search engines to enhance discoverability.

Businesses are responsible for all content they post, including service descriptions, property listings, and customer responses. Content must be accurate, non-misleading, and in compliance with all applicable advertising laws. Nexus reserves the right to moderate, amend, or remove content that does not adhere to platform policies or legal standards.

Interactions between businesses and users must be conducted professionally. Businesses must provide timely responses to inquiries, address complaints constructively, and avoid aggressive marketing tactics. While Nexus does not mediate disputes between businesses and users, it offers a framework for handling complaints and reputation management.

Businesses collecting user data through Nexus must comply with applicable data protection laws, including obtaining consent for data collection and ensuring secure storage of personal information. Businesses are prohibited from collecting sensitive personal data unless explicitly authorised.

4. Payments, Subscriptions, and Fees:

Some Nexus Business Services require payment, including premium listings, advertising, and promotional tools. Businesses agree to pay all applicable fees, which are generally non-refundable unless stated otherwise. Failure to make timely payments may result in service suspension.

Subscription-based services will renew automatically unless cancelled before the renewal date. Businesses can manage their subscriptions through their account settings, but no refunds will be issued for partial subscription periods.

5. Dispute Resolution and Complaint Handling:

Businesses with concerns regarding Nexus Business Services may submit complaints through the Complaint Handling and Dispute Resolution Procedures. Nexus strives to resolve disputes promptly and fairly.

If internal resolution efforts fail, businesses may opt for mediation through recognised bodies such as the Centre for Effective Dispute Resolution (CEDR) or the International Centre for Dispute Resolution (ICDR). If mediation does not resolve the dispute, arbitration may be pursued, and decisions rendered will be binding under applicable law.

Businesses agree that disputes will be resolved in courts applicable to their jurisdiction unless arbitration is selected as the preferred resolution method.

6. Legal Compliance and Updates:

Nexus reserves the right to update these Commercial Terms as necessary. Businesses will be notified of significant changes, and continued use of Nexus Business Services after an update constitutes acceptance of the revised terms.

Businesses must comply with all legal and regulatory obligations when using Nexus Business Services. Any confidential data or proprietary insights provided by Nexus must remain confidential and may not be shared with third parties without explicit permission.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

These Commercial Terms ensure compliance with relevant business laws and create a trusted, professional environment for businesses and their communities on Nexus.
