United States Agency Terms

These Agency Terms of Service govern the use of Nexus’s platform and services by qualifying agencies and their authorized users. By registering for an Agency account, creating an Agency Page, or using the Services, agencies and users acknowledge and agree to be bound by these Terms. These Terms supplement the Nexus Terms of Service, Privacy Policy, and Community Standards and apply specifically to agencies utilizing Nexus’s platform in an official capacity. If an agency is a federal government agency in the United States, the Federal Government Addendum to Agency Terms of Service also applies to its use of Nexus Services in addition to these Terms.

Nexus serves as a digital platform designed to facilitate communication and engagement between agencies and the communities they serve. Through Nexus, agencies have the ability to share real-time updates, emergency alerts, event notifications, and other critical information with the public. The services provided by Nexus include the creation and management of official agency pages, allowing agencies to engage with their communities effectively. Agencies can post content in various formats such as text, images, videos, and interactive media, fostering direct interaction with community members through public posts, direct messaging, surveys, and event invitations. Additionally, Nexus offers analytics and engagement insights to help agencies measure the impact of their communications. Features within Nexus also allow agencies to moderate discussions, manage user interactions, and customize accessibility settings to ensure professional and productive interactions.

Eligibility for an agency account on Nexus is limited to legally recognized public agencies, government bodies, special districts, and utility providers that serve a public interest. Qualified agencies may include federal, state, regional, county, and municipal government bodies; law enforcement agencies, fire departments, and emergency response organizations; public health agencies, hospital districts, and other entities providing essential medical information; educational institutions such as school districts and public colleges; and public utility providers offering essential services such as energy, water, waste management, and telecommunications. Each user associated with an agency account must be an officially authorized representative of the agency and must register with an official email address linked to the agency’s domain. All users are required to use their accounts exclusively for official agency communications, maintaining confidentiality of login credentials and refraining from unauthorized access sharing. Users must ensure that all communications remain professional, factual, and compliant with Nexus’s policies and applicable legal regulations. If a user leaves an agency or is no longer authorized to represent it, the agency must immediately revoke that user’s access.

Agencies bear full responsibility for all content posted under their accounts. All communications must be accurate, appropriate, and in adherence to Nexus’s Community Standards. Content shared through Nexus must contain factual, verifiable information and must not be misleading, defamatory, or deceptive. Agencies must comply with all relevant privacy laws, ensuring that personally identifiable information is not shared without appropriate consent. Content must not promote discrimination, hate speech, harassment, or inflammatory rhetoric. Agencies are strictly prohibited from engaging in political campaigning, endorsements, or lobbying activities. Additionally, agencies may not use Nexus to solicit donations, promote commercial interests, or fundraise unless explicitly approved by Nexus or legally mandated. Content must avoid inciting violence, promoting illegal activities, or posing safety threats to the public. Nexus reserves the right to remove any content that is deemed inappropriate, misleading, or in violation of these guidelines, and repeated violations may result in enforcement actions, including account suspension or removal.

When collecting public feedback or information through Nexus features such as surveys, forms, and interactive tools, agencies must clearly disclose their data collection practices, including the purpose and scope of the information being gathered. Agencies must obtain explicit consent from users before collecting personally identifiable data and comply with applicable data protection regulations, including but not limited to the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). Agencies are required to implement secure data handling procedures to prevent unauthorized access, data breaches, or misuse of information. Nexus does not assume responsibility for the data collection and storage practices of agencies, and it is the agency’s sole responsibility to ensure responsible and lawful handling of any data obtained through the platform.

To maintain trust and transparency, agencies must ensure that all account details, including names, descriptions, and contact information, are accurate and regularly updated. Agencies are required to complete Nexus’s verification process to confirm their legitimacy and official status. Impersonation of other entities or the use of misleading identifiers that could cause confusion is strictly prohibited. Any account found misrepresenting an entity or providing false information will be subject to immediate suspension or removal.

Agencies retain full ownership rights over all original content posted on Nexus. However, by utilizing Nexus’s services, agencies grant Nexus a limited, non-exclusive, worldwide, royalty-free license to display, distribute, and promote agency content within the platform for public access. Nexus may also share agency content within news feeds, community forums, and other relevant third-party integrations to enhance public communication efforts. Additionally, Nexus may utilize agency content for analytics, trend research, and platform enhancements to improve services. While Nexus does not claim ownership over agency content or commercialize it without prior explicit consent, agencies acknowledge that their content may be used for the purpose of improving public communication efforts across the platform.

Agencies and users are strictly prohibited from engaging in deceptive, fraudulent, or unauthorized communications. Sharing harmful software, phishing links, or engaging in activities that compromise the security of the platform is not permitted. Agencies and users must not attempt to exploit, hack, or disrupt Nexus’s operations. The platform may not be used for unauthorized personal, commercial, or unrelated governmental activities. Posting classified or confidential governmental information that could compromise national or local security is strictly forbidden. Agencies and users must also refrain from distributing copyrighted materials without proper authorization. Any violations of these restrictions will result in enforcement actions, including potential legal consequences.

To enforce these Terms, Nexus reserves the right to remove or modify non-compliant content, temporarily suspend or permanently deactivate agency accounts, report violations to relevant authorities where applicable, and pursue legal action in cases of severe abuse, fraud, or repeated misconduct. Agencies subject to enforcement actions may appeal through Nexus’s dispute resolution system. Before pursuing external legal action, agencies must first attempt resolution through Nexus’s internal dispute resolution mechanisms. Disputes will be governed by applicable federal, state, or municipal laws for U.S. agencies, or the governing laws of the respective jurisdiction for international agencies. Any disputes must be filed within one year of the event giving rise to the claim.

Nexus reserves the right to modify these Terms at any time. Agencies will be notified of significant updates through email or platform notifications. Continued use of the platform after an update constitutes agreement to the revised Terms. Agencies seeking assistance may contact Nexus’s support team through the Nexus Help Center. By adhering to these Terms, agencies contribute to a secure and efficient platform that enhances communication between public institutions and their communities. Nexus remains committed to supporting transparent and responsible digital engagement.
