Understanding Fair Housing Laws and Your Rights

Overview of Housing Discrimination Laws:

The purchase, sale, lease, and rental of residential and commercial properties in the United States are subject to numerous federal, state, and local laws. These laws are designed to protect individuals from housing discrimination and ensure equal access to housing opportunities for all individuals, regardless of personal characteristics or circumstances.

Key Federal Fair Housing Laws:

  1. The Civil Rights Act of 1866

    • This landmark law prohibits racial discrimination in all real estate transactions, including the sale, rental, and leasing of properties.

    • It applies to both public and private housing and ensures that no one is denied housing based on race.

  2. The Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as Amended)

    • Establishes a national policy of fair housing and prohibits discrimination in housing transactions based on:

      • Race

      • Color

      • Religion

      • Sex

      • National origin

      • Disability (Physical or Mental Impairment)

      • Familial status (Presence of children under 18, Pregnancy, Legal guardians of minors)

    • This law covers various aspects of housing transactions, including:

      • Home sales and rentals

      • Advertising and marketing of housing

      • Mortgage lending and credit access

      • Appraisals and housing-related insurance

      • Terms and conditions of leases and rental agreements

  3. The Americans with Disabilities Act (ADA) – Title III

    • Prohibits discrimination against individuals with disabilities in public accommodations and commercial facilities.

    • Ensures that housing providers and real estate professionals make reasonable modifications and accommodations for disabled individuals.

    • Requires newly constructed multi-family housing to meet accessible design standards.

  4. The Equal Credit Opportunity Act (ECOA)

    • Prohibits discrimination in credit applications, including mortgages and housing-related financing, based on:

      • Race

      • Color

      • Religion

      • National origin

      • Sex

      • Age

      • Marital status

      • Receipt of public assistance

State and Local Fair Housing Protections:

  • In addition to federal laws, many state and local jurisdictions have broader protections against discrimination in housing transactions.

  • Some states and municipalities extend protections to additional classes, including:

    • Sexual orientation

    • Gender identity and expression

    • Source of income (e.g., housing vouchers, disability benefits)

    • Military/veteran status

    • Age

    • Citizenship or immigration status

Obligations for Landlords, Home Sellers, and Real Estate Professionals:

Under federal and state laws, all landlords, home sellers, brokers, agents, and lenders have a legal responsibility to ensure that housing transactions are conducted fairly and without discrimination. Specifically, they must NOT:

  1. Refuse to sell, rent, or lease a property based on a person's protected class.

  2. Set different rental or sales terms, conditions, or privileges based on protected characteristics.

  3. Make housing unavailable by falsely claiming that a unit or property is no longer available.

  4. Steer individuals toward or away from specific neighborhoods or housing options based on race, religion, national origin, or other protected characteristics.

  5. Discriminate in mortgage lending, appraisals, or insurance practices based on a borrower's race, sex, or familial status.

  6. Publish or distribute discriminatory housing advertisements that express a preference, limitation, or discrimination against a protected class.

  7. Ask real estate agents or brokers to engage in discriminatory practices on their behalf.

  8. Engage in harassment, intimidation, or retaliation against individuals who exercise their fair housing rights or file complaints.

Your Rights as a Homebuyer, Renter, or Applicant:

Regardless of whether you are looking to rent, lease, or purchase a home or apartment, you have the legal right to:

  • Equal professional service when working with real estate agents, landlords, or lenders.

  • Access to a full range of housing options without being steered or restricted based on race, color, or religion.

  • Fair treatment in housing-related financing, insurance, and appraisals.

  • Reasonable accommodations and modifications if you have a disability.

  • Freedom from harassment and intimidation when exercising fair housing rights.
