How Rebates Work and Why Restrictions Exist:

Nexus Real Estate operates a referral brokerage model. When you are connected with a licensed real estate agent through our platform, the receiving brokerage pays a referral fee to Nexus Real Estate. A portion of that referral fee is returned to you as a rebate — a credit applied at closing, reducing your purchase price or closing costs.

In most U.S. states and all Canadian provinces and territories, this practice is fully permitted. However, a number of U.S. states restrict or prohibit the payment of rebates, credits, or fee-sharing arrangements with unlicensed consumers. These restrictions exist under state real estate licensing laws and are enforced by state real estate commissions.

Where a direct cash rebate is not permitted, we explore whether alternative forms of value — such as closing cost credits structured through the transaction, gift cards, or other lawful benefits — are available under that state's rules. Where no alternative is permissible, we will tell you clearly before you proceed.

This notice covers all 50 U.S. states, the District of Columbia, U.S. territories, all 10 Canadian provinces, and all 3 Canadian territories.

United States — State-by-State Status:

The following statuses apply:

FULLY PERMITTED — Rebate available as a closing cost credit or direct payment. RESTRICTED — Rebate available in a modified form only; specific rules apply. NOT PERMITTED — Rebates to unlicensed consumers are prohibited under state law.

  • Alabama — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit on the settlement statement or as a direct payment post-closing.

  • Alaska — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Arizona — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Arkansas — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • California — Fully Permitted Rebates are permitted and explicitly protected under California Business and Professions Code Section 10176.5. Rebate delivered as a closing cost credit or direct payment.

  • Colorado — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Connecticut — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Delaware — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • District of Columbia — Fully Permitted Rebates are permitted. Nexus Real Estate holds a Washington, D.C. brokerage license. Rebate delivered as a closing cost credit or direct payment.

  • Florida — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Georgia — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Hawaii — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Idaho — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Illinois — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Indiana — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Iowa — NOT PERMITTED Iowa Code Section 543B.34 prohibits licensed brokerages from sharing commissions with unlicensed individuals. Direct rebates to consumers are not permitted under Iowa law. Nexus Real Estate cannot provide a cash rebate or closing cost credit to buyers or sellers transacting in Iowa. We can still connect you with a high-quality licensed agent in Iowa; however, no rebate benefit will apply to your transaction.

  • Kansas — NOT PERMITTED Kansas real estate licensing law prohibits the payment of compensation, including rebates, to unlicensed persons in connection with a real estate transaction. Direct rebates to consumers are not permitted. We can still connect you with a licensed agent in Kansas; however, no rebate benefit will apply to your transaction.

  • Kentucky — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Louisiana — NOT PERMITTED Louisiana Revised Statutes Title 37, Chapter 14 prohibits the sharing of real estate commissions with unlicensed individuals. Rebates to consumers are not permitted under Louisiana law. We can still connect you with a licensed agent in Louisiana; however, no rebate benefit will apply to your transaction.

  • Maine — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Maryland — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Massachusetts — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Michigan — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Minnesota — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Mississippi — NOT PERMITTED Mississippi Code Section 73-35-21 prohibits licensed brokers from paying compensation to unlicensed individuals for real estate services. Direct rebates to consumers are not permitted. We can still connect you with a licensed agent in Mississippi; however, no rebate benefit will apply to your transaction.

  • Missouri — NOT PERMITTED Missouri real estate licensing statutes prohibit the sharing of commissions or fees with unlicensed persons. Direct rebates to consumers are not permitted under Missouri law. We can still connect you with a licensed agent in Missouri; however, no rebate benefit will apply to your transaction.

  • Montana — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Nebraska — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Nevada — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • New Hampshire — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • New Jersey — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • New Mexico — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • New York — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • North Carolina — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • North Dakota — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Ohio — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Oklahoma — NOT PERMITTED Oklahoma real estate licensing law prohibits licensed brokers from sharing compensation with unlicensed individuals. Direct rebates to consumers are not permitted under Oklahoma law. We can still connect you with a licensed agent in Oklahoma; however, no rebate benefit will apply to your transaction.

  • Oregon — RESTRICTED Oregon permits rebates but requires that the rebate be structured as a reduction in the buyer's or seller's costs rather than a direct cash payment outside of closing. Rebate will be delivered as a closing cost credit applied on the settlement statement. Direct post-closing cash payments are not available for Oregon transactions.

  • Pennsylvania — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Rhode Island — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • South Carolina — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • South Dakota — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Tennessee — NOT PERMITTED Tennessee Code Annotated Section 62-13-301 et seq. prohibits the sharing of real estate compensation with unlicensed individuals. Direct rebates to consumers are not permitted under Tennessee law. We can still connect you with a licensed agent in Tennessee; however, no rebate benefit will apply to your transaction.

  • Texas — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Utah — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Vermont — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Virginia — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Washington — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • West Virginia — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Wisconsin — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

  • Wyoming — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

U.S. Territories:

  • American Samoa — Status Under Review Real estate licensing rules in American Samoa are governed by local law. We are not currently operating in American Samoa. Please contact us for current status.

  • Guam — Fully Permitted Rebates are permitted under Guam real estate licensing rules. Rebate delivered as a closing cost credit or direct payment.

  • Northern Mariana Islands — Status Under Review We are not currently operating in the Northern Mariana Islands. Please contact us for current status.

  • Puerto Rico — Fully Permitted Rebates are permitted under Puerto Rico real estate law. Rebate delivered as a closing cost credit or direct payment.

  • U.S. Virgin Islands — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment.

Canada: Province and Territory Status:

Real estate rebates to buyers are fully permitted across all Canadian provinces and territories. There are no provincial or territorial laws that prohibit a brokerage from rebating a portion of its referral fee or commission to a consumer. Canadian transactions are administered through Canadian Benefits Nexus Inc. and the D.C.-licensed Nexus Real Estate brokerage.

The following status applies uniformly across all Canadian jurisdictions:

  • Alberta — Fully Permitted Rebates are permitted under Alberta Real Estate Act regulations. Rebate administered through Canadian Benefits Nexus Inc. and delivered as a closing cost credit or direct payment post-closing.

  • British Columbia — Fully Permitted Rebates are permitted under the Real Estate Services Act (B.C.). Rebate administered through Canadian Benefits Nexus Inc. and delivered as a closing cost credit or direct payment post-closing.

  • Manitoba — Fully Permitted Rebates are permitted under the Real Estate Brokers Act (Manitoba). Rebate delivered as a closing cost credit or direct payment post-closing.

  • New Brunswick — Fully Permitted Rebates are permitted under the Real Estate Agents Act (New Brunswick). Rebate delivered as a closing cost credit or direct payment post-closing.

  • Newfoundland and Labrador — Fully Permitted Rebates are permitted under the Real Estate Trading Act. Rebate delivered as a closing cost credit or direct payment post-closing.

  • Nova Scotia — Fully Permitted Rebates are permitted under the Real Estate Trading Act (Nova Scotia). Rebate delivered as a closing cost credit or direct payment post-closing.

  • Ontario — Fully Permitted Rebates are permitted under the Trust in Real Estate Services Act (TRESA) and its regulations. Rebate delivered as a closing cost credit or direct payment post-closing.

  • Prince Edward Island — Fully Permitted Rebates are permitted under the Real Estate Trading Act (P.E.I.). Rebate delivered as a closing cost credit or direct payment post-closing.

  • Quebec — Fully Permitted Rebates are permitted under the Real Estate Brokerage Act (Quebec) (Loi sur le courtage immobilier). Canadian Benefits Nexus Inc. is incorporated in Quebec. Rebate delivered as a closing cost credit or direct payment post-closing. Quebec Law 25 privacy protections apply to all Quebec residents.

  • Saskatchewan — Fully Permitted Rebates are permitted under the Real Estate Act (Saskatchewan). Rebate delivered as a closing cost credit or direct payment post-closing.

  • Northwest Territories — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment post-closing.

  • Nunavut — Fully Permitted Rebates are permitted. Rebate delivered as a closing cost credit or direct payment post-closing.

  • Yukon — Fully Permitted Rebates are permitted under the Real Estate Agents Registry Act (Yukon). Rebate delivered as a closing cost credit or direct payment post-closing.

What Happens If You Are in a Restricted Jurisdiction:

If you are purchasing or selling property in Iowa, Kansas, Louisiana, Mississippi, Missouri, Oklahoma, or Tennessee, the following applies:

  • You will not receive a cash rebate or closing cost credit in connection with your transaction

  • We will disclose this clearly before you are matched with an agent

  • We can still connect you with a qualified, vetted licensed agent in your market

  • Your agent match is provided at no cost to you — you simply will not receive the rebate component

  • You will still receive our full concierge matching service, transaction support, and agent coordination

If you are purchasing or selling property in Oregon:

  • You will receive a rebate, but it must be structured as a closing cost credit applied on your settlement statement

  • Direct post-closing cash or electronic payment is not available for Oregon transactions

  • Your rebate amount is the same — only the delivery method differs

We will always confirm your jurisdiction and rebate eligibility before finalizing your enrollment. If your state status changes due to legislative updates, we will notify enrolled clients and update this notice promptly.

If You Are Relocating Across Jurisdictions:

If you are selling a property in one jurisdiction and buying in another, different rules may apply to each side of your move.

Example: If you are selling a home in Tennessee (not permitted) and buying in Florida (fully permitted), you would not receive a rebate on the sale but would receive a rebate on the purchase.

We will evaluate each transaction separately and confirm your rebate eligibility for each side of your move at the time of enrollment.

For Canadian clients purchasing in the United States: Your transaction will be subject to the laws of the U.S. state where the property is located. If that state permits rebates, your rebate will be administered through Nexus Real Estate. If that state does not permit rebates, the restriction applies regardless of your Canadian residency.
