Third-Party Intellectual Property Infringement

At Nexus, we are committed to fostering a platform that supports innovation, creativity, and expression while protecting intellectual property rights. We recognize that a thriving digital community relies on trust, respect for ownership, and the legal rights of creators and businesses. As a result, we strictly prohibit the unauthorized use, reproduction, or distribution of content that infringes upon copyrights, trademarks, and other intellectual property rights.

Intellectual property rights help safeguard the work of artists, creators, businesses, and brands, ensuring that their contributions are valued, protected, and not exploited without permission. To maintain this commitment, we actively enforce policies against unauthorized content use while supporting legitimate fair use, authorized distribution, and brand protection efforts.

How We Enforce Intellectual Property Rights:

We review and act upon reports submitted by rights holders or their authorized representatives. Upon verification, we will remove, restrict, or take action against content and accounts that engage in copyright or trademark infringement, false brand affiliation, or the sale of counterfeit goods.

To report intellectual property violations, individuals or businesses can visit our Intellectual Property Help Center, explore our Business Protection page, or apply for access to Brand Rights Protection. Our Intellectual Property Transparency Report provides insights into enforcement actions taken based on verified complaints.

Prohibited Activities and Content:

1. Copyright Infringement

We remove or restrict content that infringes upon the copyrights of original creators. This includes:

  • Unauthorized reproduction or distribution of copyrighted works (e.g., music, films, books, articles, photography, software, digital art).

  • Unlicensed use of copyrighted material for commercial gain.

  • Posting or sharing content that has been previously flagged and removed for copyright violations.

  • Encouraging or facilitating copyright infringement, including providing links or instructions on how to illegally access copyrighted content.

To support legal and fair use, we allow content that has been authorized by the copyright holder or falls within the principles of fair use, such as for educational, commentary, criticism, or transformative purposes.

2. Trademark Infringement and False Affiliation

We prohibit the unauthorized use of trademarks, logos, or brand names in ways that mislead users or create confusion about affiliation, sponsorship, or endorsement. This includes:

  • Using a company’s logo, slogan, or branding without permission in ways that imply false association or endorsement.

  • Impersonating a brand to deceive users or conduct fraudulent activities.

  • Selling or promoting counterfeit goods that imitate legitimate brand products.

  • Posting content that falsely implies a partnership or endorsement with an established brand.

To protect businesses and consumers, we remove or restrict content that violates trademark rights and work closely with verified rights holders to combat brand misrepresentation.

3. The Sale or Promotion of Counterfeit Goods

We strictly prohibit the sale, promotion, or distribution of counterfeit goods, including:

  • Products falsely branded to imitate an existing company’s merchandise.

  • Counterfeit designer items such as handbags, shoes, electronics, and luxury goods.

  • Off-platform links directing users to sites that sell or promote counterfeit goods.

  • Selling or promoting products that closely resemble previously reported counterfeits.

To ensure consumer protection, we work with brand owners, legal entities, and enforcement agencies to identify and remove counterfeit listings.

4. Facilitating or Promoting Copyright or Trademark Infringement

We take action against any content that facilitates, promotes, or encourages intellectual property violations, including:

  • Sharing content that instructs users on how to access or distribute pirated material.

  • Promoting websites, groups, or entities that engage in copyright infringement.

  • Hosting or embedding unauthorized digital copies of books, movies, or other copyrighted works.

Actions Taken Against Violators:

Accounts, Groups, Pages, or other platform assets that repeatedly violate our intellectual property policies may face:

  • Content removal and account restrictions for first-time violations.

  • Warnings and content takedown notifications for infringing content.

  • Permanent account suspension for users engaging in repeated violations.

  • Legal action referrals in extreme cases where significant infringement occurs.

Allowed Content and Fair Use Protections:

We recognize and support fair use principles, allowing:

  • Content authorized by the rights holder, including licensed, collaborative, or explicitly permitted use.

  • Content shared for educational, commentary, research, or journalistic purposes where fair use exceptions apply.

  • Legitimate product reviews and discussions that reference brands or trademarks without falsely implying endorsement.

To ensure compliance, creators, businesses, and brands should review applicable intellectual property laws and obtain necessary permissions before using copyrighted or trademarked material.

Protecting the Integrity of Intellectual Property:

We are committed to:

  • Providing tools and resources for rights holders to report and protect their content.

  • Educating users about intellectual property laws and best practices.

  • Partnering with brands, creators, and enforcement agencies to combat copyright and trademark violations.

Through robust enforcement, proactive brand protection, and support for creative expression, we ensure that our platform remains a trusted space for innovation, commerce, and artistic freedom—all while respecting the rights of content owners and businesses.
